ToneSight User Agreement

Welcome to ToneSight (the "App"). The App is developed and maintained by an independent developer ("we", "us"). Please read the following terms carefully before using the App. By starting to use the App, you are deemed to have read and agreed to all terms of this agreement.

1. Service Description

The App is a local tool application for music practitioners, providing the following features:

• Real-time pitch detection and visualization (based on audio signals captured by the device microphone)
• Instrument tuner
• Metronome and rhythm training
• Recording playback, history, and practice progress tracking
• Custom reference layers and comparative analysis

The core audio processing of the App is performed locally on your device and does not rely on cloud services.

2. Subscription and Payment

Premium features ("Premium") are provided through an auto-renewing subscription (annual billing). The payment and trial rules are as follows:

• Subscription price and period: The price and billing period are shown to you in the App before you confirm your purchase (currently billed annually).
• Free trial: If a free trial is offered, it begins when you subscribe; you will not be charged until the trial ends, unless you cancel before the trial ends.
• Auto-renewal: Your subscription will automatically renew. Within 24 hours before the end of the current period, your App Store account will be charged for renewal at the same price, until you cancel.
• How to cancel: You can cancel auto-renewal at any time. On iOS, go to Settings > Apple ID > Subscriptions, or turn off auto-renewal from your App Store account page. Cancellation takes effect at the end of the current billing period; you will continue to have access to Premium until then.
• Refunds: All payments are processed through the Apple App Store. For refunds, please contact Apple Support.
• Applicable terms: Your subscription purchase is also subject to the App Store Terms of Service and Apple Media Services Terms.

3. User Responsibilities

• You shall use the App lawfully and in compliance with applicable regulations, and shall not use it for any activities that violate laws or the legitimate rights of others.
• You are responsible for properly safeguarding the data generated by the App on your device (such as recordings, reference layers, and practice records). Uninstalling the App or clearing app data will result in permanent loss of such data, and it cannot be recovered.
• You understand and agree that the App is an auxiliary practice tool and does not constitute any professional music education or medical advice.

4. Intellectual Property

All intellectual property rights of the App (including but not limited to code, interface design, icons, text, and sound resources) are owned by us and protected by applicable laws. Without written permission, you may not copy, modify, distribute, or use them for any commercial purpose.

5. Disclaimer

• The App is provided on an "as is" basis, and we make no express or implied warranties regarding its accuracy, completeness, or fitness for a particular purpose.
• In no event shall we be liable for any direct or indirect losses arising from the use of or inability to use the App.
• The App may experience functional anomalies due to device differences, system versions, or hardware limitations, and we do not guarantee compatibility with all devices.

6. Changes to the Agreement

We may update this agreement from time to time. The updated agreement will be presented within the App, and your continued use constitutes acceptance of the revisions. Significant changes will be communicated through in-app notices.
